Independent Videographer Project

About the project

TFAO seeks to both encourage and reward videographers who create and post online videos which serve to educate the public and further appreciation of American representational art

TFAO is willing to enter into a conditional agreements with independent videographers concerning videographers' creation of agreed upon videos and subsequent events.

TFAO and a videographer will agree on a topic based on thematic ideas from study of TFAO's Topics in American Representational Art.

A videographer contracting with TFAO will agree to post the agreed-upon video available on the Current.tv website for public viewing as long as Current is willing to show the video. Also, the videographer will agree to post the video on the YouTube and MySpace websites as long as those websites are willing to show the video. The videographer will also agree to post the video on the videographer's personal blog, if the videographer maintains a blog. The running time of the video will approximate the maximum time length allowed by Current.tv.

For agreed upon projects TFAO will match entertainment and information pod option exercise fees paid to videographers by Current TV. A Pod is a short video that tells a story, profiles a character and/or shares an idea.

If the video is the 1st or 2nd submission optioned by Current, TFAO will pay the videographer $500 after the later of the following: 1. the video is first shown on the Current TV network, and 2. the $500 payment is received by the videographer from Current TV.
If the video is the 3rd submission optioned by Current, TFAO will pay the videographer $750 after the later of the following: 1. the video is first shown on the Current TV network, and 2. the $750 payment is received by the videographer from Current TV.
If the video is the 4th or later submission optioned by Current, TFAO will pay the videographer $1,000 after after the later of the following: 1. the video is first shown on the Current TV network, and 2. the $1,000 payment is received by the videographer from Current TV.
TFAO's limit will be $1,000 paid for any video optioned by Current TV.

The agreement between TFAO and the videographer will extend to the videographer's assignees.

About YouTube and Current.tv

The YouTube phenomenon is turning on end behavior in watching online video. Founded in February 2005, YouTube is a consumer media company for people to watch and share original videos worldwide through a Web experience. Witness this YouTube-hosted 3 minute 20 second video featuring the European Art wing of the Indianapolis Museum of Art, a 4 minute 45 second video on art at MoMA and a 4 minute 38 second video on the Dahesh Museum of Art with Wanda Mann. A 3 minute 20 second video named South Florida Today: William Crutchfield features the artist explaining his artistic approach in connection with an exhibit at the Boca Museum of Art as seen on WXEL. As of January 2007 the company said on it's website: "YouTube is currently serving 100 million videos per day, with more than 65,000 videos being uploaded daily. According to Hitwise, YouTube videos account for 60 percent of all videos watched online and people are spending an average of 17 minutes per session on the site. According to Nielsen NetRatings, YouTube has nearly 20M unique users per month."

Another distribution site is Current.tv, backed by Al Gore, which introduces itself as fellows "Current is a global television network that gives you the opportunity to create and influence what airs on TV... Anyone who wants to contribute can upload a video. Then, everyone in the Current online community votes for what should be on TV. You can join in at either stage - watch & vote or make video."

Nature of the business relationship

TFAO will enter into an independent contractor relationship through a written agreement with an individual, business or corporation regarding the matching payments. TFAO will have the right to control or direct only the result of the work done by the independent contractor, and not the means and methods of accomplishing the result. The contractor will not be considered an employee. No taxes will be withheld from payments made by TFAO to the contractor. The contractor will be responsible for all state and federal taxes due in connection with an engagement.

TFAO may be required to file information returns to report certain types of payments made to independent contractors during the year. TFAO will file Form 1099-MISC, Miscellaneous Income, to report payments of $600 or more to persons not treated as employees (e.g. independent contractors) for services performed.

TFAO will have no copyright ownership interest in the video.

Contractor's workplace and services

Contractor will provide necessary workplace, equipment, services and talent.

Releases

Prior to any payment, contractor will provide to TFAO copies of all fully executed releases for the video in the form provided by Current TV, LLC:

music master use licenses and sync releases
appearance releases from everybody who worked on, or appears in the video
location releases for all scenes shot on private property.
artwork releases from copyright holders for all artwork shots. Hint: The copyright for an artwork rests with the artist who created the artwork, not with the owner of the physical piece of art.
